
“WHEREFORE, premises considered, the Petition for Review under Rule 43 of the Rules of Court is DENIED. The assailed Decision dated 3 April 2025 and Order dated 26 May 2025 of the Office of the Ombudsman in OMB-C-A-SEP-24-0093 are AFFIRMED.”
Thus, the Court of Appeals’ Twelfth Division denied the petition for review of Porac Mayor Jaime “Jing” Capil and affirmed the decision of the Ombudsman dismissing him from office for gross neglect of duty in connection with the raided Philippine offshore gaming operator Lucky South 99 in his municipality.

Aside from dismissal, the Ombudsman decision also imposed on Capil the accessory penalties of cancellation of eligibility, forfeiture of retirement benefits, and perpetual disqualification for reemployment in government service.
Promulgated on Dec. 9, 2025, the CA decision was penned by Associate Justice Raymond Reynold Lauigan, with Associate Justices Marie Christine Azcarraga-Jacob and Ma. Consejo Gengos-Ignalaga concurring. Justice Azcarraga-Jacob certified that the ruling was reached in consultation prior to its assignment, in compliance with constitutional requirements.
