CDC evicts MCWMC from Kalangitan Landfill

CLARK FREEPORT – The Clark Development Corp. served on Oct. 25 a notice to cease and desist operations (CDO) and a demand to peacefully vacate and turnover the property at the Kalangitan Sanitary Landfill to Metro Clark Waste Management Corp. (MCWMC).

CDC said the company refused to accept the documents, even as it stressed that MCWMC’s contract for services and authority to operate expired on Oct. 6.

CDC furthered that it fully honored the 20-day temporary restraining order (TRO) issued by the Capas Regional Trial Court that expired on Oct. 24.

In accordance with CDC’s regulatory authority under RA 7227 (Bases Conversion and Development Act of 1992), the CDO and the notice of turnover served on Oct. 25 reinforce previous communications that operations beyond the expiration of the contract for services shall be deemed unauthorized business operations. 

Also on Oct. 21, the Angeles City Regional Trial Court dismissed “with prejudice for lack of merit” the case on Reformation of Instrument, Fixing of Period, Specific Performance and Damages filed by MCWMC against CDC and the Bases Conversion and Development Authority.
